Terms of Service

These Terms govern your use of Clikr ("the Service"). By using the Service or signing in, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who we are and how to contact us
The Service is operated by Mawal AB, a Swedish private limited company (aktiebolag) registered in Sweden under Org.nr 559279-0462 (VAT SE559279046201), with its registered office at Hallandsgatan 38, 118 57 Stockholm, Sweden. Clikr turns your phone into a wireless pointing device for presentations and is delivered at www.clikr.app.

2. Acceptance and eligibility
You accept these Terms by using the Service or by signing in. You must be at least 18 years old, or the age of legal capacity to enter into a contract under the law where you live, to agree to these Terms. The Service is intended for a general adult audience and is not directed to children under 13. We do not knowingly collect personal data directly from children under 13.
If you use the Service on behalf of a business or other organization, you confirm you have authority to bind that organization to these Terms, and "you" in these Terms refers to that organization.
3. What the Service does
Clikr lets you use your phone as a wireless pointing device during presentations. A mobile web app pairs with a Chrome or Firefox browser extension over a direct peer-to-peer connection between your phone and your computer. A signaling server is used only to set up that connection.
Real-time pointer tracking depends on your network conditions, your devices, and your browser. We may change, add, or remove features of the Service over time. We do not promise that the Service will be uninterrupted or available at all times.
4. Accounts and authentication
The free tier of the Service does not require an account. To use Clikr Pro, you sign in with an account through Firebase Authentication, and your Pro access is tied to that account. Keep your sign-in credentials accurate and secure. You are responsible for activity under your account from the point at which you knew, or should reasonably have known, of unauthorized access. Tell us promptly at hello@clikr.app if you suspect your account has been used without your permission.
5. Order process and payment
Clikr Pro is a one-time purchase. You pay once and keep Pro access; there is no subscription, no recurring charge, and no automatic renewal. Paddle acts as the Merchant of Record for that purchase, which means Paddle is the legal seller to you at checkout. Mawal AB remains the provider of the Service under these Terms.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
The specific Paddle entity that sells to you depends on your region and is shown in checkout and on your order confirmation. Paddle processes your payment, issues the invoice, collects and remits applicable sales tax or VAT, and handles refunds and chargebacks. Prices are shown at checkout in the currency Paddle assigns based on your region, and include or exclude tax as Paddle indicates at checkout. Paddle's own buyer terms apply to the payment transaction in addition to these Terms; see paddle.com/legal/buyer-terms. Mawal AB does not receive or store your full card details; card data flows directly from you to Paddle.

Mawal AB handles questions about the Service itself, including your account, features, abuse reports, and technical issues; reach us at hello@clikr.app.
When you complete a purchase, you accept both these Terms and our Return Policy.
If your local consumer-protection law, or Paddle's published refund policy, gives you a longer refund window or a stronger right than these Terms or our Return Policy, the longer window or stronger right applies. For example, if our Return Policy provides a 14-day refund window and your local consumer law provides a 30-day window, the 30-day window applies.
6. Pro free trial
We offer a 14-day free trial of Clikr Pro. The trial does not require a card and does not involve Paddle. No payment is taken during the trial, and the trial does not convert into a paid purchase or a subscription. When the 14 days end, Pro features simply stop unless you choose to make the separate one-time purchase of Clikr Pro. Because no charge is ever made for the trial, there is nothing to cancel.
7. Refunds and the right of withdrawal
Refunds are processed by Paddle, not by Mawal AB directly. Paddle issues refunds to your original payment method from the original transaction. To request a refund, contact us at hello@clikr.app and we will file the request with Paddle on your behalf, or contact Paddle directly. Our Return Policy sets out the full refund terms, including the 14-day right to a refund.
If you are a consumer in the EU or EEA, you have a 14-day right of withdrawal for distance contracts under the EU Consumer Rights Directive. For digital content and services supplied during that period, that right is lost once you have given prior express consent for performance to begin, acknowledged that you lose the right, and received our confirmation in a durable medium. Consumers in the United Kingdom have an equivalent right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The mechanics are described in our Return Policy.
8. Acceptable use
Use the Service only for its intended purpose. You agree not to use the Service for anything illegal, to infringe anyone's rights, to commit fraud, or to harass others. Do not distribute malware, probe the Service for security weaknesses without our permission, or interfere with, disrupt, or overload the Service or its signaling server. Do not scrape or bulk-extract data from the Service except where the Service expressly allows it. Do not use the Service to develop or train a competing product, and do not impersonate other people or Mawal AB staff.
You agree not to reverse-engineer, decompile, or disassemble the software behind the Service, except to the limited extent that applicable law permits this despite a contractual restriction (for example, the decompilation rights granted to users under the EU Software Directive for interoperability purposes).
If you access the Service from the United States, you confirm that you are not located in, or ordinarily resident in, any country or territory subject to comprehensive US, EU, or UK sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), and that you are not on the US Treasury OFAC list of Specially Designated Nationals, the EU consolidated sanctions list, or the UK consolidated sanctions list. You agree not to use the Service for any sanctioned end-use.
9. Intellectual property and feedback
Clikr and its source code are proprietary. All right, title, and interest in the Service, including its software, design, and trademarks, remain with Mawal AB. You may not copy, modify, distribute, or create derivative works from the Service or its source code without our explicit written permission. We grant you a limited, non-exclusive, non-transferable license to access and use the Service in line with these Terms.
The Service relies on third-party services, including the browser you use and the platforms that host the Service. We are not responsible for third-party services, and their own terms apply to your use of them.
If you send us suggestions, ideas, or feedback about the Service, we may use them without any obligation to you and with no compensation owed.
10. Privacy
How we handle personal data is described in our Privacy Policy, which is part of these Terms by reference. By using the Service, you acknowledge the processing described there.
11. Suspension and termination
You may stop using the Service at any time. If you have an account, you can ask us to close it by emailing hello@clikr.app. We may suspend or terminate your access if you breach these Terms, including the acceptable-use section above, or where we reasonably suspect fraud or abuse. Where the law allows and the breach can be fixed, we will give you notice and a chance to fix it first. A user whose access we terminate for breach may not create a new account without our consent.
If your access ends, you can ask us to delete account data in line with our Privacy Policy. The sections of these Terms that by their nature should continue (intellectual property, disclaimer of warranties, limitation of liability, governing law and dispute resolution, and the preservation of your statutory rights) survive termination.
12. Disclaimer of warranties
To the extent permitted by law, the Service is provided "as is" and "as available", and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times, and pointer tracking depends on your network, devices, and browser.
This disclaimer does not affect mandatory consumer-conformity rights you have under the EU Digital Content Directive, the Swedish Consumer Sales Act (Konsumentköplagen), or the UK Consumer Rights Act. Nothing in these Terms limits or excludes any statutory right you have as a consumer. If a provision of these Terms is inconsistent with a mandatory consumer-protection rule that applies to you, that rule applies instead of the provision and the rest of these Terms continues to apply.
13. Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any liability that cannot be limited or excluded under applicable law, including your statutory rights as a consumer.
Subject to that, and to the extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, lost goodwill, lost data, business interruption, or presentation disruptions. Our total liability to you for all claims relating to the Service is limited to the greater of (i) the amount you paid Mawal AB for the Service in the twelve months before the event giving rise to the claim and (ii) one hundred euros.
14. Governing law and dispute resolution
If you have a problem with the Service, please email us first at hello@clikr.app; we aim to resolve issues directly. For order, payment, refund, billing, and tax matters, contact the Paddle entity shown in your checkout and order confirmation.
These Terms are governed by Swedish law, without giving effect to its conflict-of-laws rules. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you habitually reside, which continue to apply (Article 6 of the Rome I Regulation). Disputes may be brought before the courts of Sweden. If you are a consumer resident in the EU or EEA, you may bring proceedings against us in the courts of Sweden or in the courts of your country of residence, and we will bring proceedings against you only in the courts of your country of residence (Articles 17 to 19 of the Brussels Ia Regulation).
Where a regional consumer-protection rule, a court, or Paddle's published terms grant you a stronger right than these Terms, the stronger right applies. For example, if these Terms set a shorter complaint window than the mandatory rule in your country, the longer statutory window applies.
If you are a consumer resident in Sweden, you may also bring a complaint to the Swedish National Board for Consumer Disputes (Allmänna Reklamationsnämnden, ARN) at arn.se. Mawal AB decides whether to take part in ARN proceedings on a case-by-case basis. Consumers in the EU or EEA can find their national alternative-dispute-resolution body through the European Commission directory at consumer-redress.ec.europa.eu. If you are a consumer in the United Kingdom, Citizens Advice (citizensadvice.org.uk) can help you with consumer issues.
Under California Civil Code Section 1789.3, California users of the Service may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
15. Changes to these Terms
We may update these Terms as the Service evolves. Updated Terms are posted at this page with a new "Last updated" date. For material changes that affect paid features of the Service, we will give you at least 30 days' notice by email or a prominent in-product notice, and you may terminate your use of the paid features without penalty before the change takes effect. Continued use of the Service after the effective date is acceptance of the updated Terms.
16. Miscellaneous
These Terms, together with the Privacy Policy, the Return Policy, and any policies referenced in them, are the entire agreement between you and Mawal AB about your use of the Service, and supersede any prior agreement on the same subject.
If a court or competent authority finds any provision of these Terms to be unenforceable or invalid, that provision is severed from the Terms and the rest of the Terms continues to apply. If removing the severed provision leaves these Terms substantively unbalanced, the parties will replace it with a valid provision that achieves the closest lawful effect to the original.
If we do not enforce a provision of these Terms, that is not a waiver of our right to do so later. You may not assign or transfer these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets, provided the successor honors these Terms. We send notices to the email address on your account or, for free use, by a notice in the Service; you send notices to hello@clikr.app. We are not liable for delays or failures caused by events outside our reasonable control.
